I wanted to let you know that the petition for the Writ of Actual Innocence is now filed with the Court of Appeals.
After the attorney, Dusty and I all went over the petition several times to make sure that it was accurate, then waiting all summer for the attorney to get it filed, on July 13 I went to the attorneys office, I looked through the petition and all of the exhibits. I hand carried the box to be served to the Attorney General, Robert McDonnel and waited for an attorney to sign the form saying that they received the box containing the contents. I also went to Fed-Ex and sent the other box to Harvey Bryant, Commonwealth's Attorney.
After receiving confirmation from the above two, our attorney was able to send those along with the fee to the Court of Appeals in Richmond.
As of July, there had been over 90 petitions filed and 87 had been denied with the rest pending.
